General Terms and Conditions of Use Agreement

| Welcome to www.snowday.co.uk ('the site,' 'sites,' 'our,' 'us' or 'we') the UK's First National Register of closed schools. The site is owned and maintained by W3 Communications Ltd ('the owners'). This is the General Terms and Conditions of Use Agreement ('the Agreement') for the site. |
| Users and services For the purposes of our site Users are defined as; all individuals who use the site whether registered or unregistered. For the purposes of our site services are defined as; all services supplied by us to the user whether paid or unpaid. |
| Register For the purposes of our site Register is defined as; fully completing a set form which contains personal and service information and sending it to us along with the appropriate payment. |
| Term of agreement |
| Charges Prices charged for different service shall be stated on the site or other URL from time to time or advertised in other media. All prices include VAT at the prevailing rate. We may at any time vary all or any of the prices of the services provided. |
| Eligibility |
| All users (registered and unregistered) who enter personal and school information ('information') on the site must be 18 years of age and a legal resident in the UK. By submitting information you attest to this. All users of the site are required to provide information that is true, accurate and complete. We reserve the right to reject or delete any information that we believe is inaccurate, incomplete or fraudulent. |
| Please read the following Agreement carefully before you use our site. All users who enter information on the site must agree and comply with this Agreement. If you disagree with the Agreement please discontinue using the site. Your continued use indicates your acceptance of this Agreement in its entirety. This Agreement remains in effect as long as you are a user on the site. This Agreement can be altered at any time without prior notice and is binding on all users immediately upon display on the site. |
| The General Terms and Conditions of Use Agreement includes our Privacy Statement. It therefore forms part of this Agreement and should be read in conjunction with it. We reserve the right to alter, amend delete any or all of this Agreement at any time without prior notice. Such alterations are binding on all users immediately upon display on the site. |

| Site Services Adding a School or other similar institution Users who register to include their school, college or other similar institution on the site ('services') are deemed to accept the sites terms and conditions. E-mail and Text Alerts Parents or Legal guardians ('user' or 'users') who register to receive automatic e-mail and text alerts must be a parent or legal guardian of a pupil in the school or similar institute that they have registered to receive alerts for. For the purposes of our site and in line with the DfEE Guidelines for Schools, the definition of parent is; all natural parents whether they are married or not; any person who, although not a natural parent, has parental responsibility for a child or young person; and any person who, although not a natural parent, has care of a child or young person. Parents or legal guardians who registers to receive automatic school closure e-mail and text alerts on the site, or any combination (collectively 'services') are deemed to accept the sites terms and conditions. The terms and conditions regarding our e-mail and text alert service cover the supply of information services by Snowday.co.uk and our SMS text supplier ('supplier'). The user is responsible for providing and maintaining a cellular phone (a digital cellular handset capable of receiving SMS information services connected to one of the cellular networks) and ensuring connection to a cellular network (networks operated in the UK by; T mobile, Orange, Vodafone and 02) suitable for receiving the service from us and our supplier. The user warrants that he/she is the owner or legitimate user of the cellular phone which he/she uses to register for the service, and is authorised to incur charges on that phone. Snowday.co.uk and its supplier make no warranties, express or implied, as to the results to be obtained by any users from the use of the service. Snowday.co.uk and its supplier make no warranties, express or implied, with respect to the fitness for a particular purpose or use of the service. Snowday.co.uk and its supplier have no liability to or through the user for lost profits or consequential loss or damage arising from the use of, or inability to use, for whatever reason. Snowday.co.uk and its supplier will use all reasonable endeavours to ensure the uninterrupted and timely supply of the service and to take all reasonable steps at its own expense to correct any error, omission or mistake in the service but: Snowday.co.uk and its supplier shall be under no liability for any error in nor for any delay or failure in the transmission of the service to the user; and Snowday.co.uk and its supplier do not provide any warranty as to the accuracy and completeness of the information provided through the service; and any such liability as might arise shall be limited to the charge made to the user for the message from which such liability occurred. The user recognises that the service may from time to time be adversely affected by local geography, topography and/or atmospheric conditions and/or other causes of interference and/or network coverage of his/her chosen cellular network and/or other event that is outside our control. We reserve the right to terminate a parent or legal guardian's registration and prevent their further access to the site, if; We believe that they are not an actual parent or legal guardian of a pupil in the school or similar institute that they have registered to receive alerts for. They are prevented by law from having access to the pupil or any other pupils in the school or similar institute that they have registered to receive alerts for. It has been requested by the head teacher of the school or similar institution that they have registered to receive alerts for. It has been requested by the parent with care. This is not an exhaustive list and Snowday.co.uk reserves the right to use its own discretion in the termination of users access to the site. |
| Copyright and proprietary rights |
| The contents of the site, including all software, design, text, graphics, artwork, images, photographs, audio clips, video clips, and other material, including the selection and arrangements thereof are the property of W3 Communications Ltd. |
| We grant you a non-exclusive licence to use the site that may be terminated at any time without prior notice. You agree not to, in whole or in part, sell, copy, lease, rent, exchange, reproduce, archive, modify, create derivative works from, publish by hard copy or electronic means, publicly perform, display, disseminate, distribute, broadcast, retransmit, or circulate to any third-party or on any third-party website, or otherwise use the material in any way for any public or commercial purpose without the express approval from W3 Communications Ltd. |
| You are authorized to view and use information on the site for your personal use only, provided you do not or you do not allow any third-party to copy, adapt the object code of the Site's software, HTML, JavaScript, or otherwise, or reverse engineer, decompile, reverse assemble, modify or attempt to discover any source code that the site creates to generate its pages on the website. |
| You must not use or attempt to use, or cause any other party under your control not to use or attempt to use, any engine, software, tool, agent or other device or mechanism (including, without limitation, browsers, spiders, avatars or intelligent agents) to navigate or search the site other than (a) the search engine and search agents available from the site and (b) generally available third-party web browsers (e.g. Netscape Navigator or Microsoft Internet Explorer). |
| User conduct |
| The site provides registered users the ability to submit information (submitting). You accept, understand and agree that the accuracy of such information is the sole responsibility of the person submitting such information. This means that you the user (submitter) and not www.snowday.co.uk are entirely responsible for the content and consequences of all information submitted. Users may not submit material that is: Covered by copyright unless permission has been granted. Obscene, indecent, defamatory, threatening, harassing, abusive, hateful, or embarrassing to another user or any other person or entity and sexually-explicit images or statements. |
| The site does not represent or guarantee the truthfulness, accuracy, timeliness or reliability of any information submitted by users. You agree that any reliance on such information submitted to the site is done so at your own risk and not W3 Communications Ltd's. |
| We do not regularly review, screen or monitor the site and assume no obligation to do so and will not be liable or responsible to any user for performance or non-performance of such material. If notified by a user of any information, communication which allegedly does not conform to this Agreement, the site may in its sole discretion investigate the allegation and may thereafter determine whether or not to remove or request the removal of the material. We reserves the right to expel users and prevent their further access to the site for violating this Agreement or any applicable law, and may remove communications which are considered to be unlawful, harmful, threatening, abusive, obscene, indecent, libelous, disruptive, hateful, infringing, or racially, ethnically or otherwise objectionable. |
| User Registration |
| As a registered user you receive a secure username and password. You understand, acknowledge and agree that you are responsible for maintaining the confidentiality of this information as defined in this Agreement. You will be fully responsible for all uses of your registration and for any activity that occurs under your password or account, whether or not authorized by you. You further agree to immediately notify us of any unauthorized use of your registration and/or password. |

| You understand and acknowledge that we do not endorse, verify, make any representations, or take responsibility for the content, truthfulness, accuracy, quality or completeness of the content or activities conducted on any third party linked web site or hyperlinks. |

| Security |
| You are not permitted to: Probe, scan or test the vulnerability of the system or network or to breach the security or authentication measures of the site without proper authorization. Interfere with service to any user, host or network, including, without limitation, via means of submitting a virus to the Site, overloading, "flooding", "spamming," "mailbombing," or "crashing" the site or the server of any user. |
| Indemnification and limitation of liability |
| You understand, acknowledge and agree to defend, indemnify, and hold harmless W3 Communications Ltd and their respective officers, directors, employees, representatives and agents, from and against any claims, actions or demands, alleging or resulting from your use of information or your breach of the terms of this Agreement. |

The site makes no representations about the accuracy, reliability, completeness, or timeliness of the site or its information, and the site makes no guarantee that the site will meet your requirements.
